Pinnacle Alliance Fund, Inc. Property Leasing

Pinnacle Alliance Fund, Inc. (PINNACLE) believes in making every effort necessary when leasing property for an individual, bank, company or other entity. As acting Broker, we provide a Listing Agreement between the Owner and PINNACLE. A Listing Agreement will reflect Information obtained from the property owner and will meet the demands of each property. Services rendered include, but are not limited to:

Sales Brokerage Services

Brokers Obligations

Sales and Marketing Plan submitted to Owner within twenty (20) days of obtaining Property:
  • Development of brochures, sales aids, and special sales materials for the Property
  • Market and attempt to sell the Property in accordance with the approved Sales and Marketing Plan
  • Show property to all prospective purchasers
  • Cooperate with any brokers who have or may have prospective purchasers
  • Deliver all offers (written and oral), with respect to the sale of the Property, to Owner
  • Qualify prospective purchasers using procedures reasonably requested by Owner
  • At Owners request, assist Owner in the negotiation of the terms of prospective agreements
  • At Owners request, in the event Owner enters into a definitive agreement for the sale of the Property, assist Owner with closing obligations
  • Use reasonable efforts to sell the Property during the Term in accordance with the terms of this agreement
  • Perform Sales Brokerage Services under agreement in a professional and prudent manner.

Marketing Reports

Delivered on or before the tenth day of each calendar month during the Term and shall include, without limitation:
  • Identification of potential new sales, including any person or persons making inquiry with respect thereto
  • Updated status of sales previously identified as potential sales
  • Listing of all potential sales for which discussions have been terminated and if known, the reasons therefore
  • Issues or other matters which render continued compliance with the Approved Plan

Broker not to make representations

PINNACLE has no authority to and shall not make representations or warranties of any kind, express or implied, as to any fact, matter or issue relating to the Property, including, without limitations, the existence or presence on the property:
  • Construction, design or natural defects of any kind or nature, whether patent or latent
  • "Hazardous Materials" or "Toxic Substances" as such terms are defined under applicable law
  • Violations of any federal, state or local law, regulation, restrictions or covenants applicable

Broker not to accept deposits

PINNACLE has no authority to and shall not accept any earnest money or other deposit in connection with an offer or contract to purchase any of the Property; however should PINNACLE receive earnest money or deposits in connection with a purchase, the Owner shall be immediately notified and such funds delivered to a title company designated by Owner as escrow agent.
